A federal court case that argues President Obama probably is not even a U.S. citizen, much less a “natural born citizen” as required by the U.S. Constitution of the chief executive officer, has been scheduled by the 3rd U.S. Circuit Court of Appeals for June 29.

In a letter dated yesterday to Mario Apuzzo, the attorney representing plaintiff Charles Kerchner and others, the clerk of the court said the case has been “tentatively listed on the merits on Tuesday, June 29, 2010.”

The notice said there is a possibility the case would have to be moved, and the court “will determine whether there will be oral argument and if so, the amount of time allocated for each side.”

Those decisions would be announced later if necessary, the notification said.

On a blog dealing with the case, lead plaintiff Kerchner wrote that the case will be addressed by three members of the 3rd Circuit, but those names have not yet been announced.

WND previously has reported on the case that was filed against Obama, Congress and others, just before Obama was sworn into office. Sign the petition that asks state officials to validate Barack Obama’s constitutional eligibility.

It has argued that, “Under the British Nationality Act of 1948 his father was a British subject/citizen and not a United States citizen and Obama himself was a British subject/citizen at the time Obama was born.”

“We further contend that Obama has failed to even conclusively prove that he is at least a ‘citizen of the United States’ under the Fourteenth Amendment as he claims by conclusively proving that he was born in Hawaii, the arguments have claimed.

Those claims from Apuzzo came in opposition to government demands that the case be dismissed for lack of “standing” on the part of the plaintiffs.

Apuzzo has argued that standing should be a simple decision.

“How can you deny he’s affecting me?” Apuzzo told WND during a recent interview. “He wants to have terror trials in New York. He published the CIA interrogation techniques. On and on. He goes around bowing and doing all these different things. His statements we’re not a Christian nation; we’re one of the largest Muslim nations. It’s all there.”

The case was brought by Apuzzo in January 2009 on behalf of Charles F. Kerchner Jr., Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr.

Named as defendants are Barack Hussein Obama II, the U.S., Congress, the Senate, House of Representatives, former Vice President Dick Cheney and House Speaker Nancy Pelosi.

The case alleges Congress failed to follow the Constitution, which “provides that Congress must fully qualify the candidate ‘elected’ by the Electoral College Electors.”

The complaint also asserts “when Obama was born his father was a British subject/citizen and Obama himself was the same.” The case contends the framers of the U.S. Constitution, when they adopted the requirement that a president be a “natural born citizen,” excluded dual citizens.

Apuzzo’s latest filing has been posted online.

It argues that Obama’s arguments “are nothing more than presentations of general statements on the law of standing which do not address the specific factual and legal content of plaintiffs’ claims. … The defendants in much of their brief basically tell the court that the Kerchner case should be dismissed because all other Obama cases have been dismissed.”

Apuzzo said it is “self-evident” under the Constitution that “anyone aspiring to be president has to conclusively prove that he or she is eligible to hold that office. Part of that burden is conclusively showing that one is a ‘natural born citizen.’ Hence, the citizenship status of Obama is critical to the question of whether plaintiffs having standing, for it is that very statute which is the basis of their injury in fact.”

He noted the case was filed before Obama became president.

“At this time he was still a private individual who had the burden of proving that he satisfied each and every element of Article II, Section 1, Clause 5. That plaintiffs filed their action at this time is important for it not only sets the time by which we are to judge when their standing attached to their action against Obama, Congress and the other defendants … but also to show that Obama has the burden of proof to show that he is a ‘natural born citizen’ and satisfied the other requirements of Article II,” Apuzzo wrote.

“At no time in these proceedings or in any other of the many cases that have been filed against him throughout the country has Obama produced a 1961 contemporaneous birth certificate from the state of Hawaii showing that he was born there … We must conclude for purposes of defendants’ motion that since Obama is not a 14th Amendment ‘Citizen of the United States’ let alone an Article II ‘natural born citizen,’ he is not eligible to be president and commander in chief. Not being eligible to be president and commander in chief he is currently acting as such without constitutional authority. It is Obama’s exercising the singular and great powers of the president and commander in chief without constitutional authority which is causing plaintiffs’ injury in fact.”

WND has reported on dozens of legal challenges to Obama’s status as a “natural born citizen.” The Constitution, Article 2, Section 1, states, “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.”

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama’s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama’s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born. And still others contend he holds Indonesian citizenship from his childhood living there.

Adding fuel to the fire is Obama’s persistent refusal to release documents that could provide answers and the appointment – at a cost confirmed to be at least $1.7 million – of myriad lawyers to defend against all requests for his documentation. While his supporters cite an online version of a “Certification of Live Birth” from Hawaii as his birth verification, critics point out such documents actually were issued for children not born in the state.

WND also has reported that among the documentation not yet available for Obama includes his kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records and his adoption records.

Because of the dearth of information about Obama’s eligibility, WND founder Joseph Farah has launched a campaign to raise contributions to post billboards asking a simple question: “Where’s the birth certificate?”

The campaign followed a petition that has collected more than 499,000 signatures demanding proof of his eligibility, the availability of yard signs raising the question and the production of permanent, detachable magnetic bumper stickers asking the question.

The “certification of live birth” posted online and widely touted as “Obama’s birth certificate” does not in any way prove he was born in Hawaii, since the same “short-form” document is easily obtainable for children not born in Hawaii. The true “long-form” birth certificate – which includes information such as the name of the birth hospital and attending physician – is the only document that can prove Obama was born in Hawaii, but to date he has not permitted its release for public or press scrutiny.

An appeals court has indicated it is listening to arguments in a case that challenges Barack Obama’s occupancy in the Oval Office with a ruling that gives special permission for an extra-long document to be filed in the case.

WND has reported on the case brought by attorney Mario Apuzzo in January 2009 on behalf of Charles F. Kerchner Jr., Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr.

Named as defendants were Barack Hussein Obama II, the U.S., Congress, the Senate, House of Representatives, former Vice President Dick Cheney and House Speaker Nancy Pelosi.

The case alleges Congress failed to follow the Constitution, which “provides that Congress must fully qualify the candidate ‘elected’ by the Electoral College Electors.”

The complaint also asserts “when Obama was born his father was a British subject/citizen and Obama himself was the same.” The case contends the framers of the U.S. Constitution, when they adopted the requirement that a president be a “natural born citizen,” excluded dual citizens.

However, Apuzzo wrote, “because of the extraordinary nature and complexity of the question of whether putative President Barack Obama is an Article II ‘natural born citizen’ and therefore eligible to be president, whether my clients … have standing to bring an action against Obama and Congress in which they maintain that Obama is not a ‘natural born citizen’ and that Congress failed to meet its constitutional duty to protect my clients by assuring them that Obama is a ‘natural born Citizen…’ I was compelled to file a brief which contained 20,477 words.”

“By order dated February 22, 2010, the Honorable Circuit Judge Michael A. Chagares on behalf of the Motion’s Panel of the 3rd Circuit Court of appeals granted plaintiffs’ motion for leave to file the overlength brief.”

“This is great news because the case will now continue forward as scheduled,” he said. “Obama’s and Congress’s opposition brief was initially due on Feb. 22, 2010. The Department of Justice obtained a 14-day extension to file that brief, making the new due date March 8, 2010.

“After they file their opposition brief, I will then have 14 days within which to file a reply to that brief,” he said.

He said his background information in the case confirms that two U.S. Supreme Court decisions reveal the definition for “natural born citizen” is found not in the Constitution but in common law.

“We maintain that Obama is not an Article II ‘natural born citizen’ because he lacks unity of citizenship and allegiance from birth which is obtained when a child is born in the United States to a mother and father who are both United States citizens at the time of birth,” he said.

“Obama’s father was only a temporary visitor to the United States when Obama was born and never even became a resident let alone a citizen. Not being an Article II ‘natural born citizen,’ Obama is not eligible to be president and commander in chief,” he said.

He also argues that Obama has failed to prove that he was born in Hawaii by revealing his documentation.

“If he fails to do so, the alleged fact is not proven, even if the opposing party produces no further evidence,” he said.

On Apuzzo’s website, a forum page participant said, “It will be interesting to see how Mr. Obama’s legal team stretches, ‘We have nada!’ into 14,000 words.”

The lead plaintiff, Kerchner, has posted an online statement: “This is not going to go away until Obama stops hiding ALL his hidden and sealed early life documents and provides original copies of them to a controlling legal authority and reveals his true legal identity from the time he was born until the time he ran for president.

“Obama at birth was born British and a dual citizen. He holds and has held multiple citizenship during his lifetime. He’s a citizenship chameleon as the moment and time in his life suited him and he is not a ‘natural born citizen’ with sole allegiance … to the USA as is required per the Constitution,” he said.

The appeal further challenges that not only might Obama not be a “natural born citizen,” he might not even be in the United States legally.

“If Obama was not born in the United States, there exists a possibility that Obama could be an illegal alien,” it states.

Campaign seeks investigation by attorneys general of documentation

Tens of thousands of faxes and letters are being sent to attorneys general in all 50 states asking them to investigate whether President Obama’s state elections submissions included an affirmation that he is qualified and eligible to hold the office of president – and whether those statements constitute perjury.

The campaign has been assembled by Gary Kreep of the United States Justice Foundation, which already is involved in the issue with a case in California on behalf of presidential candidate and former Ambassador Alan Keyes.

That case challenges Obama’s eligibility to be on the ballot in California and is on appeal now after being delayed for months in the federal court system.

The campaign states, “Frankly, the evidence that Barack Hussein Obama was born in Africa – not Hawaii as he claims – and, therefore, cannot serve as the president of the United States, is compelling.”

Among the issues it cites:

  • “First, Mr. Obama’s refusal to release his birth certificate. If he has nothing to hide, what does he gain by refusing to allow the press to see the birth certificate?
  • Second, the contention by Barack Obama’s half-sister, Maya Soetoro-Ng, that Mr. Obama was born in a particular Hawaiian hospital, only to claim that it was in a different hospital several years later.
  • Third, the erecting of a wall around Barack Obama’s grandmother, the late Madelyn Dunham, by Mr. Obama, thus cutting off access to the one person then alive who would have been present if he was actually born in Hawaii.
  • Fourth, the posting of law enforcement personnel at the two hospitals in Honolulu mentioned by Ms. Soetoro-Ng in an effort to block the press from discovering the truth about the birth certificate.
  • Fifth, a taped phone conversation with Mr. Obama’s step-grandmother in Kenya, who claims that she was present at his birth … in what is now called Kenya!
  • Sixth, the “birth certificate” posted on the Obama campaign website and other liberal websites. Since Barack Obama was born in 1961, long before laser printers and office computers, his original birth certificate would be typewritten … unlike the laser printed “copy” purported to be genuine.

Kreep noted his organization’s efforts to obtain copies of Obama’s Occidental College records from the 1980s, which reportedly could reveal whether Obama was attending as a foreign student, an effort that resulted in a threat from Obama’s attorneys to seek financial sanctions against the plaintiff’s lawyers.

Now he’s arranged on his website a campaign to contact attorneys general. The letter he is asking people to send says:

“I hope and pray that you will do your duty by fully investigating whether Barack Obama committed perjury, or violated another state law … by falsely claiming that he was constitutionally eligible to serve as President of the United States!

“It is critical that your office fully investigate whether Barack Obama was born in Hawaii or not, for the answer to this question is the crux of the matter, and is of the utmost importance for the resolution of this extremely important Constitutional issue.”

Kreep told WND that while the campaign has been going on only a few days, thousands of people already have taken part.

“We believe Mr. Obama is not qualified to serve,” he told WND. “We believe he is not a natural born citizen. If he is he would have proven it by now.”

The campaign targets the specific paperwork political candidates file in each state to be on the ballot. Most, if not all, he explained, include an affirmation that the candidate is qualified and/or eligible to hold the office.

“If he falsely filed those papers, that’s perjury,” Kreep said. “It is a criminal act and should be prosecuted.”

Adding fuel to the fire is Obama’s persistent refusal to release documents that could provide answers. While his supporters cite an online version of a “Certification of Live Birth” from Hawaii, critics point out such documents actually were issued for children not born in the state.

While an Obama spokesman one time called the allegations “garbage,” the president and his team have withheld other comments. But here is a partial listing and status update for some of the cases over Obama’s eligibility:

  • New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn’t properly ascertain that Obama is qualified to hold the office of president.
  • Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama which is under seal at the U.S. District Court level and Hollister vs. Soetoro a/k/a Obama, (now dismissed) brought on behalf of a retired military member who could be facing recall to active duty by Obama.
  • Leo Donofrio of New Jersey filed a lawsuit claiming Obama’s dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.
  • Cort Wrotnowski filed suit against Connecticut’s secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.
  • Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public’s support.
  • Chicago lawyer Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama’s vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.
  • Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama’s eligibility could be confirmed, alleging doubt about Obama’s citizenship. His case was denied.
  • In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.
  • Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.
  • In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama’s citizenship. The case was denied.
  • In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama’s birth certificate. His request for an injunction against Georgia’s secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.
  • California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.

  • In Ohio, Gordon Stamper vs. U.S. later was dismissed.

WorldNetDaily reports that a citizen Grand Jury, made up of 25 people from Georgia and with the authority of the Magna Carta, has indicted Barack Obama for taking office while failing to be eligibile for the office of President of the United States.  The indictments were delivered to the U.S. attorney for the Northern District of Georgia, state officials and leaders of the Georgia Senate and House.

President Obama has been named in dozens of civil lawsuits alleging he is not eligible to be president, with one man even filing a criminal complaint alleging the commander-in-chief is a fraud, and now a citizen grand jury in Georgia has indicted the sitting president.

The indictment delivered to state and federal prosecutors yesterday is one of the developments in the dispute over Obama’s eligibility to be president under the U.S. Constitution’s requirement that presidents be “natural born” citizens.

Orly Taitz, a California attorney working on several of the civil actions, also announced she has filed another Quo Warranto case in the District of Columbia, where, she told WND, the statutes acknowledge that procedure.

The Quo Warranto claim essentially calls on Obama to explain by what authority he has assumed the power of the presidency.

Georgia resident Carl Swensson, whose work is detailed on his Rise up for America website, told WND he got tired of the issues over Obama’s eligibility, as well as his performance in office.

“I took it upon myself to find as many patriots as I could across the state, for the purpose of seating 25 for a grand jury,” he said.

Over the weekend the jurors took sworn testimony from several sources, including Taitz, and then generated an indictment that later was forwarded to the U.S. attorney, the state attorney general and others in law enforcement across the state.

Swensson cites on his website as authority for the grand jury the Magna Carta, the bill of rights that formed the foundation of British common law on which U.S. law is based.

He said the members were chosen, sworn in and observed all of the rules of procedure. Swensson declined to elaborate on the specific allegations about Obama, telling WND that remains confidential at this point because of the possibility of a prosecution.

However, the website explanation of the procedure includes some intimidating language.

“If the government does not amend the error within 40 days after being shown the error, then the four members shall refer the matter to the remainder of the grand jury,” it says. “The grand jury may distrain and oppress the government in every way in their power, namely, by taking the homes, lands, possessions, and any way else they can until amends shall have been made according to the sole judgment of the grand jury.”

Swensson said the indictments were delivered to the U.S. attorney for the Northern District of Georgia, state officials and leaders of the Georgia Senate and House.

He told WND that since the action in Georgia, he’s been contacted by groups in at least 20 other states who want to pursue a similar action.

Meanwhile, Taitz told WND she has forwarded to U.S. Attorney Jeffrey Taylor in Washington, D.C., a request for the U.S. to relate Quo Warranto “on Barack Hussein Obama, II to test his title to president.”

Named as plaintiffs in the action are nine military or legislative leaders, including Allen C. James, currently on active duty in the U.S. Army in Iraq. Others include several retired military leaders as well as elected state representatives.

“Relators request that as U.S. Attorney, you institute a Quo Warranto proceeding against Obama under DC Code § 16-3502, and demand that Obama show clear title, proving, with clear and convincing evidence, that he had qualified as president elect,” Taitz told Taylor.

“By each relator’s constitutional oath of office, and interest above other citizens and taxpayers, relators submit that they have standing,” Taitz wrote.

“In arguendo of Respondent Obama’s burden of proof, motions are submitted requesting mandamus on Hawaii Gov. Linda Lingle for evidence, and on Sec. State Hillary Rodham Clinton for evidence and to request evidence from Britain and the Republics of Kenya, Indonesia and Pakistan,” Taitz said.

She told WND the case was filed in the District of Columbia because the district recognizes the procedure. Taitz, who is working on her cases through the Defend Our Freedoms Foundation, cites a legal right established in British common law nearly 800 years ago and recognized by the U.S. Founding Fathers to demand documentation that may prove – or disprove – Obama’s eligibility to be president.

She previously submitted a similar case to U.S. Attorney General Eric Holder.

The legal phrase essentially means an explanation is being demanded for what authority Obama is using to act as president. An online constitutional resource says Quo Warranto “affords the only judicial remedy for violations of the Constitution by public officials and agents.”

John Eidsmoe, an expert on the U.S. Constitution now working with the Foundation on Moral Law, said the demand is a legitimate course of action.

“She basically is asking, ‘By what authority’ is Obama president,” he told WND. “In other words, ‘I want you to tell me by what authority. I don’t really think you should hold the office.’

“She probably has some very good arguments to make,” Eidsmoe said.

WND has reported on dozens of legal challenges to Obama’s status as a “natural born citizen.” The Constitution, Article 2, Section 1, states, “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.”

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama’s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama’s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Several of the civil cases already have involved emergency appeals to the U.S. Supreme Court in which justices have declined even to hear arguments.

Eidsmoe said it’s clear that Obama has something in the documentation of his history, including his birth certificate, college records and other documents, “he does not want the public to know.”

What else could be the reason for his hiring law firms across the nation to fight any request for information as basic as his Occidental College records from the early 1980s, he asked.

According to the online Constitution.org resource: “The common law writ of quo warranto has been suppressed at the federal level in the United States, and deprecated at the state level, but remains a right under the Ninth Amendment which was understood and presumed by the Founders, and which affords the only judicial remedy for violations of the Constitution by public officials and agents.”

According to author Chester Antieau in his “The Practice of Extraordinary Remedies,” Quo Warranto is one of the oldest rights in common law.

“The earliest case on record appears in the 9th year of Richard I, 1198,” he wrote. “The statute of 9 Anne c. 20 in 1710 authorized a proper officer of a court, with leave of the court, to exhibit an information in the nature of quo warranto, at the ‘relation’ of any person desiring to prosecute the same – to be called the relator. Early American statutes were modeled after the Statute of Anne and, indeed, the statute has often been ruled to be part of the common law we inherited from England.”

Antieau noted the Pennsylvania Supreme Court has ruled, “Quo warranto is addressed to preventing a continued exercise of authority unlawfully asserted, rather than to correct what has already been done. …”

Its first recognized purpose, he said, is “to determine the title of persons claiming possession of public offices and to oust them if they are found to be usurpers.”

Among those who are subject to its demands, under court precedent, are chief executives in other U.S. governmental positions, including governors and sheriffs.

As WND has reported on several occasions, none of the so-called “evidence” of Obama’s constitutional eligibility produced thus far is beyond reasonable doubt nor as iron-clad as simply producing an authentic birth certificate, something Americans are required to do regularly but the president still refuses to do.

Adding fuel to the fire is Obama’s persistent refusal to release documents that could provide answers. While his supporters cite an online version of a “Certification of Live Birth” from Hawaii, critics point out such documents actually were issued for children not born in the state.

As Jerome Corsi, WND senior staff writer, explained, “The main reason doubts persist regarding Obama’s birth certificate is this question: If an original Hawaii-doctor-generated and Hawaii-hospital-released Obama birth certificate exists, why wouldn’t the senator and his campaign simply order the document released and end the controversy?

“That Obama has not ordered Hawaii officials to release the document,” Corsi writes, “leaves doubts as to whether an authentic Hawaii birth certificate exists for Obama.”

Obama officials repeatedly have declined comment, relenting only one time to call such allegations “garbage.”

WND also has reported that Taitz’ appeals have been submitted to the U.S. Supreme Court and the U.S. Justice Department, where officials confirmed they received the paperwork.

WND reported earlier on a proposal by U.S. Rep. Bill Posey, R-Fla., and the criticism he’s taking for suggesting that the issue be avoided in the future by having presidential candidates supply their birth certificate.

  • Sen. Mel Martinez, R-Fla.: “Presidential candidates are vetted by voters at least twice – first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party’s nomination after one of the most fiercely contested presidential primaries in American history. And, he has now been duly elected by the majority of voters in the United States. Throughout both the primary and general election, concerns about Mr. Obama’s birthplace were raised. The voters have made clear their view that Mr. Obama meets the qualifications to hold the office of president.”
  • Sen. Sherrod Brown, D-Ohio: “President Obama has provided several news organizations with a copy of his birth certificate, showing he was born in Honolulu, Hawaii on August 4, 1961. Hawaii became a state in 1959, and all individuals born in Hawaii after its admission are considered natural-born United States citizens. In addition, the Hawaii State Health Department recently issued a public statement verifying the authenticity of President Obama’s birth certificate.”
  • U.S. Rep. Rush Holt, D-N.J.: “The claim that President Obama was born outside of the United States, thus rendering him ineligible for the presidency, is part of a larger number of pernicious and factually baseless claims that were circulated about then-Senator Obama during his presidential campaign. President Obama was born in Hawaii.” The response provided no documentation.

  • New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn’t properly ascertain that Obama is qualified to hold the office of president.
  • Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama which is under seal at the U.S. District Court level and Hollister vs. Soetoro a/k/a Obama, (now dismissed) brought on behalf of a retired military member who could be facing recall to active duty by Obama.
  • Leo Donofrio of New Jersey filed a lawsuit claiming Obama’s dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.
  • Cort Wrotnowski filed suit against Connecticut’s secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.
  • Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public’s support.
  • Chicago lawyer Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama’s vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.
  • Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama’s eligibility could be confirmed, alleging doubt about Obama’s citizenship. His case was denied.
  • In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.
  • Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.
  • In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama’s citizenship. The case was denied.
  • In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama’s birth certificate. His request for an injunction against Georgia’s secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.
  • California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.

  • In Texas, Darrel Hunter vs. Obama later was dismissed.
  • In Ohio, Gordon Stamper vs. U.S. later was dismissed.
  • In Texas, Brockhausen vs. Andrade.

  • In Hawaii, Keyes vs. Lingle, dismissed.

Gary Kreep of the United States Justice Foundation also has confirmed to WND a civil case brought on behalf of Ambassador Alan Keyes, a candidate for president on California’s general election ballot last year, challenging Obama’s eligibility will be appealed.

WND reported earlier on the case being filed and then again when a judge dismissed it after concluding anyone can run for president on the California ballot – whether or not they are eligible under the Constitution of the United States.

Judge Michael P. Kenny said the secretary of state, who is responsible for election laws in the state, has no “duty” to demand proof of eligibility from candidates.

“The judge’s ruling in the case that only Congress and only on Jan. 6 of each year following a presidential election can object as to whether the nominee is eligible to serve as president of the United States is, in our opinion, completely wrong and eviscerates the [Constitutional] requirements for serving as president in the United States Constitution,” Kreep said.

“If Mr. Obama is not constitutionally eligible to serve as president of the United States, then no act that he takes is, arguably, valid, the laws that he signs would not be valid, the protective orders that he signs would be null and void, and every act that he takes would be subject to legal challenge, both in courts of the United States of America, and in international courts, and that, therefore, it is important for the voters to know whether he, or any candidate for president in the future, is eligible to serve in that office,” the case explained.

WorldNetDaily reports that, in Washington State, attorney Stephen Pidgeon is being followed by local and federal law enforcement.

Pidgeon has a complaint filed against Obama contending Obama is ineligible to be President of the United States.  Washington State is different in this case because State law gives citizens the right to raise questions about a candidate’s eligibility where in other states, the majority of eligibility cases are dismissed because judges routinely deny the cases for lack of “standing”.

A lawyer spearheading the effort in Washington state to bring light to the issue of Barack Obama’s eligibility to be president says he was shadowed all day today by officers with the federal Department of Homeland Security, the Snohomish County sheriff’s office and the Everitt city police department.

“There’s definitely observation,” attorney Stephen Pidgeon told WND. “Maybe observation in anticipation of making an arrest.”

Pidgeon has been the attorney for Washington state plaintiffs challenging Obama’s eligibility to be president under the Constitution’s demand for that office to be occupied only by a “natural born” citizen. Dozens of similar cases have been filed around the country since the election and many have been dismissed, often because judges rule the plaintiffs don’t have “standing” to bring a complaint.

The Washington state case, however, cites state law that vests in citizens the right to raise questions about an elected official’s authority, effectively granting standing to those plaintiffs.

The case, although it has been filed, has not been brought to court for hearings yet.

Pidgeon told WND today he contacted his personal defense attorney, and also was in contact with the Alliance Defense Fund, a national organization advocating for civil liberties and religious and personal freedoms.

Pidgeon is affiliated with the organization and told WND that there would be a letter sent inquiring about the surveillance.

He said he first became aware of the situation when his wife left their rural home early in the day and reported there were three law enforcement vehicles parked nearby, along with three black Suburban-style vehicles carrying camouflage-wearing agents, apparently from Homeland Security.

Pidgeon said he has been “outspoken” about the Obama administration and its validity due to the eligibility questions, but didn’t realize he was “qualifying as an enemy of the state.”

He immediately reached out to a number of individuals through e-mail.

“My only protection is to contact the people I know,” he said.

Officials of the Department of Homeland Security did not return multiple WND messages seeking a comment on the situation. Officials with the Snohomish sheriff’s office and the Everett city police department said they didn’t know anything about it.

“Where Homeland Security is concerned, obviously there are people working for the Obama administration with little consideration for free speech,” Pidgeon told WND.

He said when he left his home, he had a sheriff’s vehicle “marking every turn that I made.”

“There’s definitely observation,” he said.

“The fact of the matter is that we have taken the position and it is consistent with Orly Taitz’ position that Barack Obama failed to establish his bona fides by the election on November 4,” he said. “We alleged under Democratic National Committee rules he had a burden to establish to the DNC’s satisfaction his eligibility. He never did.

“As a consequence the burden remains on him. He didn’t meet the burden of proving his eligibility to hold the office.”

He said voters cannot simply rewrite the Constitution’s eligibility requirements in a presidential vote. For one thing, only 52 percent voted for Obama, and the Constitution requires approval from two-thirds of the states for an amendment.

He also cited U.S. senators and congressman who have credited the online “fact” organizations such as snopes or factcheck for authenticating Obama’s eligibility.

“Any senator who would rely on snopes or factcheck to establish a judicial opinion whether or not this person has documented his eligibility is a fool,” Pidgeon said. And citing a federal judge who said the issue of Obama’s eligibility already had been “twittered,” he said that is “tantamount to malpractice.”

Several hours after Pidgeon returned WND’s call, he called again.

“We are definitely under surveillance and it’s coordinated with Homeland Security,” he said.

He said one of his associates had been followed from his home to the law firm’s downtown office, and the associate was stopped just outside the building.

“The police officer claimed he didn’t have brake lights working,” Pidgeon said. “But he does.”

An ex-military officer has raised the stakes in the ongoing dispute over Barack Obama’s eligibility to be president, filing a criminal complaint against the “imposter” with the U.S. attorney’s office for the Eastern District of Tennessee.

Retired U.S. Navy officer Walter Francis Fitzpatrick III, who has run a campaign for two decades to uncover and try to correct what he believes are criminal activities within the military, accused the president of “treason.”

In his complaint addressed to Obama via U.S Attorney Russell Dedrick and Assistant U.S. Attorney Edward Schmutzer, Eastern District, Tennessee, Fitzpatrick wrote: “I have observed and extensively recorded invidious attacks by military-political aristocrats against the Constitution for twenty years.

“Now you have broken in and entered the White House by force of contrivance, concealment, conceit, dissembling, and deceit. Posing as an impostor president and commander in chief you have stripped civilian command and control over the military establishment.”

He cited the deployment of “U.S. Army active duty combat troops into the small civilian community of Samson, Ala.,” and said, “We come now to this reckoning. I accuse you and your military-political criminal assistants of TREASON. I name you and your military criminal associates as traitors. Your criminal ascension manifests a clear and present danger. You fundamentally changed our form of government. The Constitution no longer works.

“I identify you as a foreign born domestic enemy,” he wrote.

The 1975 graduate of the U.S. Naval Academy in Annapolis told WND that a short time after his complaint was filed he was visited by two U.S. Secret Service agents, but they left after telling him they perceived no threat to the president in the document.

Officials with the Knoxville office of the Secret Service told WND the only person who could release information to the media was on vacation and they would not comment on the issue.

Likewise, officials with the U.S. attorney’s office declined to respond to a WND request for a comment.

Fitzpatrick told WND the U.S. Justice Department needs to look into the issue.

WND reported this week that officials at the Justice Department, along with those at the Supreme Court, confirmed that documentation in a case challenging Obama’s eligibility had arrived and was scheduled for an evaluation.

That case is being handled by California attorney Orly Taitz, who is working through her Defend Our Freedoms Foundation to handle several cases raising questions over Obama’s qualification to be president under the Constitution’s demand that the office be occupied only by a “natural born” citizen.

Taitz was informed by Karen Thornton of the Department of Justice that all of the case documents and filings have arrived and have been forwarded to the Office of Solicitor General Elena Kagan, including three dossiers.

Fitzpatrick said he has devoted his career fulltime to investigating issues in military justice and defending wrongly accused soldiers, sailors and Marines. His own career was torpedoed by a court-martial more than 20 years ago over his authorization of the use of a ship’s fund to sent an officer to the funeral for his brother, who had been killed by terrorists.

Fitzpatrick’s situation has been described not only on his own website but forum pages on other websites that deal with military issues.

He alleges his case was fabricated and even his signature was forged by officials connected to his case. He points to the fact that he ultimately retired and was awarded a military pension as support for his allegations.

But he says the new complaint against Obama should define the issue of the president’s eligibility.

“They either have to come and get me or get Mr. Obama’s eligibility proved. He has an officer in his military saying he is guilty of trespass on the Constitution,” Fitzpatrick told WND.

“They can recall me against my will to active duty,” he said. “I would refuse. It’s an illegal order by a man who is not by commander in chief.”

Adding fuel to the fire is Obama’s persistent refusal to release documents that could provide answers. While his supporters cite an online version of a “Certification of Live Birth” from Hawaii, critics point out such documents actually were issued for children not born in the state.

Hawaiian officials have confirmed they have a birth certificate on file for Obama, but it cannot be released without his permission, and they have not revealed the information it contains.

John Eidsmoe, an expert on the U.S. Constitution working with the Foundation on Moral Law, has told WND a demand for verification of Obama’s eligibility appears to be legitimate.

Eidsmoe said it’s clear that Obama has something in the documentation of his history, including his birth certificate, college records and other documents that “he does not want the public to know.”

Officials for the Obama campaign repeatedly have refused to comment on the questions, relenting only once to call the concerns “garbage.”

The U.S. Supreme Court and the U.S. Justice Department today confirmed that documentation challenging Barack Obama’s eligibility to be president has arrived and soon will be evaluated.

Confirmation came from DefendOurFreedoms.us, the foundation through which California attorney Orly Taitz has been working on a number of cases that raise questions over Obama’s birth location, and therefore his qualifications to be president under the Constitution’s demand that the office be occupied only by a “natural born” citizen.

According to the blog, Taitz was informed by Karen Thornton of the Department of Justice that all of the case documents and filings have arrived and have been forwarded to the Office of Solicitor General Elena Kagan, including three dossiers and the Quo Warranto case.

“Coincidently, after Dr. Taitz called me with that update, she received another call from Officer Giaccino at the Supreme Court,” the posting said. “Officer Giaccino stated both pleadings have been received and being analyzed now.”

The report from the Supreme Court also said the documents that Taitz hand-delivered to Chief Justice John Roberts at his appearance at the University of Idaho a little over a week ago also were at the Supreme Court.

WND has reported on dozens of legal challenges to Obama’s status as a “natural born citizen.” The Constitution, Article 2, Section 1, states, “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.”

Some of the legal challenges question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama’s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

WND reported earlier on a proposal by U.S. Rep. Bill Posey, R-Fla., and the criticism he’s taking simply for suggesting that the issue be avoided in the future by having presidential candidates supply their birth certificate.

“What you should do is stop embarrassing yourself and take the Reynolds Wrap off your head,” MSNBC commentator Keith Olbermann suggested to Posey, and U.S. Rep. Neil Abercrombie, D-Hawaii, has gone so far as to suggest that Posey’s judgment is skewed.

“The citizenship of someone who has reached the point of running for president of the United States is not really an issue,” Abercrombie said.

Posey said he made the suggestion because he’s seeking the truth, and “the more and more I get called names by leftwing activists, partisan hacks and political operatives for doing it, the more and more I think I did the right thing.”

  • Sen. Jon Kyl, R-Ariz.: “Thank you for your recent e-mail. Senator Obama meets the constitutional requirements for presidential office. Rumors pertaining to his citizenship status have been circulating on the Internet, and this information has been debunked by Snopes.com, which investigates the truth behind Internet rumors.”
  • Sen. Mel Martinez, R-Fla.: “Presidential candidates are vetted by voters at least twice – first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party’s nomination after one of the most fiercely contested presidential primaries in American history. And, he has now been duly elected by the majority of voters in the United States. Throughout both the primary and general election, concerns about Mr. Obama’s birthplace were raised. The voters have made clear their view that Mr. Obama meets the qualifications to hold the office of president.”
  • Sen. Sherrod Brown, D-Ohio: “President Obama has provided several news organizations with a copy of his birth certificate, showing he was born in Honolulu, Hawaii on August 4, 1961. Hawaii became a state in 1959, and all individuals born in Hawaii after its admission are considered natural-born United States citizens. In addition, the Hawaii State Health Department recently issued a public statement verifying the authenticity of President Obama’s birth certificate.”
  • U.S. Rep. Rush Holt, D-N.J.: “The claim that President Obama was born outside of the United States, thus rendering him ineligible for the presidency, is part of a larger number of pernicious and factually baseless claims that were circulated about then-Senator Obama during his presidential campaign. President Obama was born in Hawaii.” The response provided no documentation.

Taitz had approached Justice Antonin Scalia during his appearance in Los Angeles before meeting with Roberts at his Idaho appearance. She’s suggested that there was misbehavior at the Supreme Court because some of her earlier papers were not filed properly, nor were they returned to her.

Hers was just one of the issues reportedly presented to the Supreme Court justices in conference for an evaluation on whether a hearing should be held. No hearing ever has been held at that level on the evidence involved. Her Quo Warranto case is pending at the Justice Department. It essentially raises a demand for proof by what authority Obama has assumed the powers of president.

Here is a partial listing and status update for some of the cases over Obama’s eligibility:

  • New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn’t properly ascertain that Obama is qualified to hold the office of president.
  • Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama which is under seal at the U.S. District Court level and Hollister vs. Soetoro a/k/a Obama, (now dismissed) brought on behalf of a retired military member who could be facing recall to active duty by Obama.
  • Leo Donofrio of New Jersey filed a lawsuit claiming Obama’s dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.
  • Cort Wrotnowski filed suit against Connecticut’s secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.
  • Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public’s support.
  • Chicago attorney Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama’s vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.
  • Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama’s eligibility could be confirmed, alleging doubt about Obama’s citizenship. His case was denied.
  • In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.
  • Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.
  • In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama’s citizenship. The case was denied.
  • In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama’s birth certificate. His request for an injunction against Georgia’s secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.
  • California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.
